Kaduna: The Shari’a Court I in Magajin Gari, Kaduna, has instructed a woman, Rubayya Muhammad, who is pursuing a divorce, to bring her parents to court due to a disagreement over the dowry amount.
According to News Agency of Nigeria, Rubayya Muhammad, who is also a nursing mother, requested the court to dissolve her marriage with her husband, Isiya Baba, through a process known as Khul’i. She expressed her willingness to return the dowry of N150,000 that she claimed to have received in exchange for the divorce.
Khul’i is a procedure under Islamic law where a woman can initiate divorce by returning the dowry to her husband. Muhammad stated her intention to use the dowry money to support their two-month-old baby.
The defendant, Isiya Baba, contested her claim, asserting that he had paid a dowry of N350,000, not the N150,000 mentioned by Muhammad. Witnesses from Baba’s side also testified in court, corroborating that the dowry amount was N350,000, which was given to Muhammad’s parents.
Judge Mu’awiya Shehu then inquired from Muhammad who received the dowry, to which she responded that it was her father who accepted it.
